Terms of Service

1. Introduction
Welcome to echolens. These Terms of Service (“Terms”) govern your access to and use of our website, products, and services (collectively, the “Services”). By accessing or using any part of the Services, you agree to abide by these Terms. If you do not agree with any part of these Terms, you may not use the Services.

2. Definitions

  • “echolens,” “we,” “us,” or “our” refers to echolens and its affiliates.

  • “User,” “you,” or “your” refers to any individual or entity accessing or using the Services.

  • “VIP Reservation” refers to a paid reservation that provides early access and special benefits (e.g., exclusive accessories, discounted pricing) but does not guarantee shipment of a product until a later date.

  • “Content” means all text, images, designs, data, files, or other materials provided by echolens or submitted by Users in connection with the Services.

3. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to use the Services. By using the Services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. Account Registration & Security

  • To access certain features (e.g., VIP Reservations, order tracking), you must create an account. You agree to provide accurate and complete information and to keep your password and contact information up to date.

  • You are responsible for all activities that occur under your account. If you believe your account has been compromised, notify us immediately at support@echolenscamera.com.

  • We reserve the right to suspend or terminate accounts that use fraudulent or unauthorized information, or otherwise violate these Terms.

5. VIP Reservations

  • Reservation Purchase

    • A VIP Reservation secures early access and special benefits (e.g., exclusive accessories, priority ordering) once echolens products are available for purchase.

    • VIP Reservation fees are non-refundable and non-transferable, except as expressly set forth in our Refund & Return Policy.

  • Conversion to Purchase

    • When echolens announces availability, you will receive an email with instructions on how to complete your product order. Your VIP Reservation fee will be applied toward that purchase.

    • If you choose not to finalize the product order within the specified timeframe, the reservation fee remains forfeited.

  • Modification & Cancellation

    • You may not modify or cancel a VIP Reservation after purchase.

    • echolens reserves the right, at its sole discretion, to cancel or modify a VIP Reservation in exceptional circumstances (e.g., product discontinuation). If we cancel your VIP Reservation, we will contact you and may issue a refund or alternative credit at our discretion.

6. Product Orders & Shipping

  • Product Descriptions
    All product illustrations, descriptions, specifications, and prices are subject to change at any time without notice. We attempt to be as accurate as possible; however, we do not warrant that product descriptions or other content are error-free.

  • Pricing & Payment

    • All prices are listed in U.S. dollars unless otherwise stated.

    • Payment methods accepted include major credit/debit cards and any other methods explicitly offered on the website.

    • You agree to pay all fees associated with your order. We reserve the right to correct pricing errors.

  • Shipping

    • Shipping timelines and costs vary by destination and will be provided at checkout.

    • Risk of loss and title for products purchase passes to you upon our delivery to the carrier.

    • echolens is not responsible for delays caused by third-party carriers, customs, or force majeure events.

7. Intellectual Property

  • Ownership
    All content and materials provided through the Services— including but not limited to text, graphics, logos, images, button icons, software, and audio—are owned by echolens or its licensors and are protected by copyright, trademark, and other intellectual property laws.

  • Limited License
    Subject to your compliance with these Terms, echolens grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use.

  • Restrictions
    You may not (a) reproduce, distribute, or publicly display echolens Content except as expressly permitted; (b) modify, adapt, or create derivative works; (c) use echolens trademarks in connection with any product or service without our prior written consent; or (d) reverse engineer any portion of the Services.

8. User Content

  • Definitions
    “User Content” refers to any text, images, feedback, or other materials you submit through the Services.

  • License to echolens
    By submitting User Content, you grant echolens a perpetual, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works of, distribute, and display such User Content in any media.

  • Responsibility
    You are solely responsible for your User Content. You represent and warrant that you own all rights in your User Content or have obtained all necessary licenses, permissions, and consents, and that your submissions do not violate any third-party rights.

9. Prohibited Conduct
You agree not to:

  1. Use the Services for any unlawful purpose or in violation of any applicable laws or regulations.

  2. Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.

  3. Interfere with or disrupt the Services, servers, or networks connected to the Services.

  4. Upload, post, or transmit any viruses, worms, Trojan horses, or other harmful code.

  5. Attempt to gain unauthorized access to other users’ accounts or to any part of the Services.

  6. Use automated scripts or scraping tools to collect data from the Services without our express permission.

10. Third-Party Links & Services

  • The Services may contain links to third-party websites, services, or resources. echolens does not control these third parties and is not responsible for their content, accuracy, or practices.

  • Your interactions with third parties are solely between you and the third party. echolens will not be liable for any loss or damage incurred as a result of those interactions.

11. Disclaimers

  • No Warranties
    The Services and all content are provided “as is” and “as available” without warranty of any kind, whether express, implied, or statutory. echolens expressly disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

  • Accuracy of Information
    Although we strive to ensure accuracy, echolens does not guarantee that information available through the Services is error-free or up to date.

12. Limitation of Liability

  • To the fullest extent permitted by law, in no event shall echolens, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to these Terms or your use of (or inability to use) the Services, even if echolens has been advised of the possibility of such damages.

  • In no event will echolens’s total liability to you for all claims or damages exceed the amount you paid to echolens in the twelve (12) months preceding the event giving rise to the claim.

13. Indemnification
You agree to indemnify and hold harmless echolens, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or in any way connected with: (a) your breach of these Terms; (b) your violation of any law or rights of a third party; or (c) your use of the Services.

14. Termination

  • echolens may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice.

  • Upon termination, all licenses and rights granted to you under these Terms will immediately cease. Sections 5 (VIP Reservations), 6 (Product Orders & Shipping), 7 (Intellectual Property), 9 (Prohibited Conduct), 11 (Disclaimers), 12 (Limitation of Liability), 13 (Indemnification), 15 (Governing Law), and 16 (General Provisions) shall survive termination.

15. Governing Law & Dispute Resolution

  • These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

  • Any dispute arising from or related to these Terms or your use of the Services shall be resolved exclusively in the federal or state courts located in Los Angeles County, California. You hereby consent to the personal jurisdiction and venue of such courts.

16. Changes to These Terms
echolens reserves the right to modify or revise these Terms at any time. We will post the updated Terms on our website and update the “Last Updated” date at the bottom. Continued use of the Services after any changes constitutes your acceptance of the new Terms.
